The saga continues in the case of The Sneaky Chef author Missy Chase Lapine and Jerry Seinfeld, the New York Daily News reports.

Lapine sued Seinfeld’s wife, Jessica Seinfeld, accusing her of plagiarism, saying Seinfeld’s book, Deceptively Delicious, also about incorporating vegetables in meals that taste good, was a rip off.

After a federal judge said, “No,” Lapine took the case to a Second Circuit Court of Appeal, and argued that a jury should decide if pureed carrots are unique.

The Appellate court has yet to issue a ruling.

When it comes to cookbooks, plagiarism and copyright issues are shady, because recipes generally aren’t copyrightable (although it’s best to always say where you got it or developed it from).

The U.S. Copyright office has this to say about recipes:

“Mere listings of ingredients as in recipes, formulas, compounds, or prescriptions are not subject to copyright protection. However, when a recipe or formula is accompanied by substantial literary expression in the form of an explanation or directions, or when there is a combination of recipes, as in a cookbook, there may be a basis for copyright protection.”

Green beans, onions and carrots together as a dish probably isn’t copyrightable.

The song you wrote to put your kids in a trance to eat them that you printed along with the recipe in the cookbook probably is.

As previously reported, Jennie Garth has become involved with Veggie Central, in an effort to help parents get their children to eat more vegetables.

Garth said she was surprised to learn that so many kids’ idea of fruit is a fruit rollup and that vegetables are often scarce on the plate.

“I was shocked to find out how many kids are not provided with fruits and vegetables every day, which is why I was happy to be a part of this campaign.”

Besides growing her own produce at home, Garth also employs techniques to sneak vegetables into meals, something she learned from Missy Chase Lapine‘s book, The Sneaky Chef, according to Celebrity Baby Scoop.

“We have our own garden and have a great appreciation for fresh vegetables at our house, but I have been known to use The Sneaky Chef cookbook now and then.”

Garth said that is she could do some things about parenting over again, she would only provide her children with organic foods and wishes she’d never introduce her daughter Fiona to sugar.

Who ever thought you could “get legal” with produce?

A judge has thrown out a case against the wife of comedian Jerry Seinfeld, Jessica Seinfeld, by the author of a kids cookbook.

Missy Chase Lapine had alleged that Jessica’s book, Deceptively Delicious: Secrets to Getting Your Kids Eating Good Food, was so highly similar to Lapine’s The Sneaky Chef: Simple Strategies for Hiding Healthy Foods in Kids’ Favorite Meals, Jessica must be plagiarizing!

“We are pleased that the court saw through this sham and dismissed the baseless copyright claim,” Orin Snyder, attorney for the Seinfelds said.

Jerry had joked about the incident on the The Late Show with David Letterman, calling it “vegetable plagiarism.”

The main differences between Jessica’s and Missy’s book, the U.S. court judge Laura Swain ruled, was that Jessica’s is “bright and cheerful, full of different colors and various patterns,” while Missy’s is “a dry, rather text-heavy work.”

Jessica created the book because she and Jerry have a child that’s a picky eater.
